Terms

Upon approval, credit terms are Net 30 days from date of invoice. Terms are indicated on the invoice. Late fees of 1.5% per month (18% per year, but not in excess of the maximum permitted by law) are assessed on balances exceeding terms and future orders may not be shipped if account balances exceed terms. Should Native Sun Press consign a past due account to a third party for collection, all costs and expenses, including attorney's fees, are the responsibility of the customer.

Policies

Backorders:
We are willing to supply or cancel backorders at your preference. Most of our customers routinely backorder out-of-stock or not-yet-printed titles, and we will honor any time limit you request for canceling backorders. Unless notified otherwise, we will automatically backorder all qualifying titles.

Shipping/Freight Terms:
All orders of in stock products will ship within the United States via NSP’s preferred carriers. Customers may request to ship via other delivery methods. Shipments are F.O.B. origin, freight prepaid.

Returns and Credit:
Acceptable returns will be credited at the account's annual volume discount. No permission to return is required. Please mark multiple box returns as "1 of 3," "2 of 3," etc. Include your packing slip in the first carton.

Strip Cover Returns:
NSP accepts strip cover returns for select titles. Strip cover returns must be itemized by title to be acceptable for credit.

Overstock Returns:
Overstock returns must be in clean, saleable condition (e.g. no stickers, tears, bent jackets, scuffs, discolorations, etc.). Overstock returns are not accepted before 90 days after invoice date. There is no set maximum time limit other than below. For books returned in unsaleable condition, including stickered, shopworn or otherwise damaged conditions, NSP reserves the right to refuse credit for the returned product. At its discretion NSP may choose to issue credit for returns of stickered books, but such returns will be subject to a $.50 per unit chargeback for each stickered book.

Calendar Returns:
Calendars sold as returnable must be returned no later than April 30 of the calendar's year. Strip covers are acceptable.

Damaged Items:
Return of product damaged in shipping must be received no later than 120 days from the invoice date.

Discontinued Items:
All items are returnable until declared out of print or announced in trade publications as no longer distributed by NSP. Return of out of print titles and old editions are acceptable if received up to, but not beyond 180 days after the date of the announcement. No longer distributed titles are also acceptable up to 180 days after the announcement.

Violation /Vendor Compliance Claims:
NSP does not credit or pay vendor compliance/violation claims.

Returned in Error:
NSP is not responsible for items returned to us in error. We will notify you on your credit memo of any titles returned to NSP in error (no longer carried, not our title, etc.). You may request to have the books returned at your expense. We will recycle the books 30 days after our notification if we do not receive a request for return. Contact our Customer Service Department if you would like all unacceptable items automatically returned to you.

Postage Credit:
Please state on your packing list what postage you are paying to return damaged, defective, or misshipped items so that your claim may be expedited. If no postage amount is declared, your account will be credited at a rate assigned by NSP, which may not reflect your actual charges. NSP does not credit handling, insurance, or penalty charges.

Non-receipt:
Claim within 90 days of the invoice date. After this period payment on the invoice is required.

Short Shipment:
Claim within 60 days of the invoice date. NSP’s original invoice number is required for credit.

Misships:
Claim within 60 days of the invoice date. NSP’s original invoice number is required for credit.

Liability:
We do not make any representations or warranties of any kind, express or implied, with respect to the contents of the works we distribute. We do not vet or censor the works, and we are not responsible for the works or their content. We have no obligation to indemnify you or anyone who purchases from you with respect to the works we sell. We will use reasonable commercial efforts to fulfill your orders, but will not be liable for any incidental or consequential damages which you may suffer as a result of our breach of our obligations, even if we have been advised of the possibility of such damages.
